Associate Counsel

o Associate Counsel staff members will work in a highly confidential capacity under the immediate supervision of OAH's Associate Deputy Commissioner, Downstate Director, or Chief Hearing Officer. They will guide, ask questions, and advise when they see potential problems. They will offer solutions and will work with Internal Control officers to reduce risk. Identifying legal issues is a key component of the job. Considering alternatives, researching, evaluating, discussing, and building cohesive solutions is the minimum acceptable performance. o Associate Counsels must answer questions, consider recommendations, and develop workable legal solutions. They will meet and discuss issues with other OAH leaders, plaintiffs, advocacy groups, Districts, managed care plans, federal and State agencies, OTDA program area experts, other administrative hearing offices, the Division of the Budget, Commissioner's Office, Inter-governmental affairs, Strategic Operations, and the New York State Attorney General's Office. Associate Counsels will work collaboratively with internal and external partners. o All Associate Counsels will participate in high level meetings and staffing interviews. Each will train OAH staff members, develop and update scripting tools, and help build a single, consistent, coordinated OAH across the State. o Associate Counsels will hold hearings (including home hearings and expedited Medicaid hearings as assigned), issue well-reasoned decisions on the Commissioner's behalf, investigate and resolve constituent complaints, answer legal questions, improve operations, resolve problems cost-effectively with appreciation for unintended consequences, lead teams as assigned, focus on discrete legal issues affecting fair hearings, supervise Supervising Hearing Officer(s), Hearing Officers, Project Assistants, Senior Attorneys, other attorneys and trainees, Fair Hearings Specialists, and other OAH staff members. o All Associate Counsels will receive and review data, highlight areas of concern and interest, regularly brief OAH's leadership team, work collaboratively, and recommend how to optimize staffing and technological resources. o Litigation:
An Associate Counsel will review judicial determinations and briefs, determine likely outcomes, and understand legislative intent to ensure OAH operations meet changing law and precedents. The selected candidate will be responsible for managing home hearings and may review Freedom of Information Law and similar requests and consider whether they foreshadow litigation. o The selected litigation Associate Counsel candidate will monitor overall timeliness and identify when case allocation percentages need revision, identify potential matters ripe for lawsuits and resolve the issue before litigation is filed, manage class action litigation, draft declarations and affidavits, recommend edits and revisions to Office of the Attorney General papers, redraft and update OAH notices and public-facing information, and determine the process due to appellants or recipients to comply with the US and New York State Constitutions. o Organizational Procedural Management:
An Associate Counsel will develop policies and procedures for public reasonable and religious accommodations, draft mandated reports for submission to the Legislature and the Governor, as well as publication in the New York State Register, and evaluate whether an expedited Medicaid hearing is required by reviewing submitted evidence. The selected candidate will provide legal counsel, advice, and recommend policy, procedural, operational, statutory, and regulatory changes. o The Associate Counsel selected to specialize in Organizational Procedural Management will draft and redraft regulations as appropriate including supporting documentation, draft legislative bills and supporting memoranda to implement OAH's objectives, present ideas in meetings with OTDA and government leaders, and review and develop OAH comments on legislation. The selected candidate will design procedures associated with new social services benefit program laws, regulations, and court decisions. o The Associate Counsel responsible for Organizational Procedural Management will create, draft, and evaluate demonstration projects. Additionally, the selected candidate will coordinate with the Division of Legal Affairs and the Department of State, and respond to inquiries from the Governor's Office, the Regulatory Review Unit, and the public relating to proposals. Finally, the selected Associate Counsel will consider legal hurdles and how to overcome them as OAH and OTDA moves forward with the Integrated Eligibility System, ever-evolving technological changes, and revised rules and standards while considering conflicting interested parties, budgetary constraints, and staffing concerns. Salary Range:
From $105500 to $133319 Annually
Minimum Qualification
This position is pending non-competitive. Candidates must be admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.Estimated Salary: $20 to $28 per hour based on qualifications.
