Assistant Counsel (Supervising Assistant Special Prosecutor)

Serve as Supervising Assistant Special Prosecutor to the agency's Special Prosecutor/Inspector General and perform the following functions, including but not limited to:
o Review criminal investigations and make charging decisions. Draft and review charging documents, gather documentation, prepare witnesses, conduct hearings and trials, and generally, prosecute suspects accused of committing acts of abuse and neglect against vulnerable persons. o Supervise a small team of Assistant Special Prosecutors assigned to the same geographic region. o Work closely with local district attorneys' offices regarding cases within their respective jurisdictions. Advise on charging considerations and collateral consequences unique to cases associated with allegations of abuse and neglect committed by caregivers under agency jurisdiction. o Consult and advise NYS Justice Center's investigators on pending investigations. Interview witnesses, including vulnerable persons, and advise on the appropriate course of action for pending investigations. o Appear on behalf of the agency at administrative proceedings, defending subject substantiations under the Protections of People with Special Needs Act. o Handle employee discipline matters as part of agency representation of State Oversight Agencies pursuant to collective bargaining agreements. o Draft motions, decisions, opening/closing arguments, memoranda of law and briefs in support of agency determinations; prepare documentary evidence and witnesses for testimony at administrative and disciplinary proceedings o Participate in local and statewide task forces and organizations dealing with issues relating to the criminal investigations and prosecution of persons charged with abuse or neglect of vulnerable New Yorkers. Provide training on legal issues to law enforcement, prosecutors and advocacy organizations. Provide training to internal agency staff as well as external agency stakeholders regarding administrative litigation practices. oTravel is required up to 30% of time. Much of travel time focused in Western New York, as well as several annual meetings in Albany.

Minimum Qualification
Admission to the New York State Bar and a member in good standing with seven (7) years post-bar admission experience. Commitment to public service and excellent research/writing skills are essential. NYS residency required. The preferred candidate will have at least five (5) years of experience as a criminal prosecutor, preferably with experience with victim-driven prosecutions including a background in trauma-informed interviews. While not required, some appellate experience is a plus.Estimated Salary: $20 to $28 per hour based on qualifications.

Don't Be Fooled

The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
